Terms and Conditions – App User

By activating and using ‘Ente Palli’ mobile application (referred as ‘App’) created by Wyze Media and Technology Inc., the user of the app (referred as ‘User’) agrees to the following terms and conditions.

1. By using ‘Ente Palli’ app, the User guarantees that the User has full copyright of the content uploaded via App to our server(s). Wyze Media and Technology Inc. will not be liable for any copyright violations of data uploaded to our server(s).
2. The User agrees to use the data available via the App for personal use only; the User agrees that the data available via the App will not be shared with other individuals or organizations (including non-profit organizations). The User will be responsible for any incidents caused by sharing the data with other individuals/organizations; Wyze Media and Technology Inc. will not be held responsible for any incidents caused by unauthorized sharing of data by the User(s).
3. The User agrees to not use the data available thru the App for business use (businesses include, but not limited to, personal business, for profit business and non-profit organizations)
4. Wyze Media and Technology Inc. will try to implement reasonable data security measures; The User agrees that Wyze Media and Technology Inc. will not be held responsible for data breach (and the subsequent incidents caused by data breach) by bad actors
5. The User agrees that Wyze Media and Technology Inc. can use the data uploaded to their servers
6. The User agrees that Wyze Media and Technology Inc. will not be held responsible for increased cellular/wireless/wifi/any other data usage caused by the App
7. The User agrees that Wyze Media and Technology Inc. will not be held responsible for problems/issues on the device(s) on which the App is installed
8. The User agrees to allow Wyze Media and Technology Inc. to collect data about how the App is used
9. The User agrees that Wyze Media and Technology Inc. will not be held responsible for inappropriate content added by User(s) and/or Organization(s)
10. The User agrees that Wyze Media and Technology Inc. will not be held responsible for errors, delays and any other problems caused by actions or inactions of the User(s) of the App or the Organizations using it.
11. The User agrees to receive push notifications via the App
12. The User agrees that the User will stop using the App by logging out if the User does not agree with any of the terms and conditions
13. The User agrees that Wyze Media and Technology Inc. has the right to discontinue/terminate the service without notice.
14. The User agrees that the services provided via the App are provided ‘as-is’ without warranty of any kind, either expressed or implied, including, not limited to, fitness for a particular purpose
15. The User agrees that Wyze Media and Technology Inc. will not be held responsible for the accuracy of data displayed via the App
16. As a condition of using the Service, the User warrants that the User will not use the Service for any purpose that is unlawful or is not permitted, expressly or implicitly, by the terms of this Agreement or by any applicable law or regulation. The User further warrants and represents that the User will not use the App in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the App. The User may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the App. The User agrees that these warranties and representations will remain in full force and effect even if this Agreement terminates for any reason.
17. The User agrees to indemnify, defend and hold harmless Wyze Media and Technology Inc., its affiliates, partners, officers, directors, employees, consultants, service providers and agents from any and all third-party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of the Service, reliance on the information, your violation of the Terms or your infringement, or infringement by any other user of any intellectual property or other right of any person or entity.
18. The User agrees that rights and remedies (for Wyze Media and Technology Inc.) arising out of any breach of the User’s representations and warranties, the limitations on the liability and the rights to indemnification under this Agreement are continuing and shall survive the termination of this Agreement, notwithstanding the lack of any specific reference to such survivability in these provisions. Wyze Media and Technology Inc.’s failure to enforce the strict performance of any provision of this Agreement will not constitute a waiver of the right to subsequently enforce such provision or any other provisions of this Agreement.
19. The User agrees that the User will not copy, reproduce, distribute, or create derivative works, reverse engineer or reverse compile any of the services or technology provided by Wyze Media and Technology Inc.
20. The User agrees that that Wyze Media and Technology Inc. will not be responsible for data on a lost device(s) and how the data from the lost device(s) is used.

Terms and Conditions – Organization

By using ‘Ente Palli’ web application (referred as ‘Web App’) created by Wyze Media and Technology Inc., the Organization providing the data of its members (referred as ‘Organization’) to be displayed via the mobile application (referred as ‘App’) agrees to the following terms and conditions.

1. By using ‘Ente Palli’ Web App, the Organization guarantees that the Organization has full copyright of the content uploaded via Web App to our server(s). Wyze Media and Technology Inc. will not be liable for any copyright violations of data uploaded to our server(s).
2. The Organization agrees to inform and educate the members on the importance of not sharing the data available through the App to other individuals and organizations.
3. Wyze Media and Technology Inc. will try to implement reasonable data security measures; The Organization agrees that Wyze Media and Technology Inc. will not be held responsible for data breach (and the subsequent incidents caused by data breach) by bad actors
4. The Organization agrees that Wyze Media and Technology Inc. can use the data uploaded to their servers
5. The Organization agrees that Wyze Media and Technology Inc. will not be held responsible for increased cellular/wireless/wifi/any other data usage caused by the Web App
6. The Organization agrees that Wyze Media and Technology Inc. will not be held responsible for problems/issues on the device(s) on which the Web App is used
7. The Organization agrees to allow Wyze Media and Technology Inc. to collect data about how the Web App is used
8. The Organization agrees that Wyze Media and Technology Inc. will not be held responsible for inappropriate content added by User(s) and/or Organization(s)
9. The Organization agrees that Wyze Media and Technology Inc. will not be held responsible for errors, delays and any other problems caused by actions or inactions of the User(s) of the App or the Organizations using it.
10. The Organization agrees that the it will stop using the Web App by logging out if the Organization does not agree with any of the terms and conditions; also, Organization will inform all its members and ask everyone to log off from the App.
11. The Organization agrees that Wyze Media and Technology Inc. has the right to discontinue/terminate the service without notice.
12. The Organization agrees that the services provided via the App are provided ‘as-is’ without warranty of any kind, either expressed or implied, including, not limited to, fitness for a particular purpose
13. The Organization agrees that Wyze Media and Technology Inc. will not be held responsible for the accuracy of data displayed via the App
14. The Organization understands that the notifications to the members may not reach the App users in time or sometimes it will not reach at all; The Organization agrees that Wyze Media and Technology Inc. will not be held responsible for non-deliverance of notifications to App Users.
15. As a condition of using the Service, the Organization warrants that the User will not use the Service/Web App for any purpose that is unlawful or is not permitted, expressly or implicitly, by the terms of this Agreement or by any applicable law or regulation. The Organization further warrants and represents that the Organization will not use the Web App in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Web App/App. The Organization may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Web App/App. The Organization agrees that these warranties and representations will remain in full force and effect even if this Agreement terminates for any reason.
16.
